Trademarks, logos and other distinguishing marks of any kind appearing in the Website belong to their respective owners.
The use of trademarks, logos and other distinctive signs, including reproduction on other websites by unauthorized third parties, is forbidden .
The Website contents (texts, graphics, images and animations) are protected by copyright; it is also forbidden to reproduce images and to publish them in any form without Carmens' written permission.
The following general conditions of sale apply to each purchase of Products through the Website

ART. 1 - DEFINITIONS
1.1. "Customer" is the subject (either natural or legal person) who makes purchases on the Website, in compliance with the general terms and conditions of sale.
1.2 “Consumer Code” is the Italian D. Lgs 06.09.2005, n. 206.
1.2. "Contract" means the contract for the sale of the Products, according to the general terms and conditions of sale.
1.3. "Order" is the application form of the sold Products, completed by the Customer through the Website.
1.4. “Parts” are Carmens and the Customer.
1.5. “Price” is the Products’ sale price.
1.6. “Products” are the goods sold by the Website, according to the general terms and conditions of sale.
1.7. “Website” is the online website www.carmens.it.

ART. 2 - TECHNICAL MODES OF CONCLUSION OF THE CONTRACT
2.1. These General Conditions of Sale (hereinafter the “General Conditions of Sale”) govern the offers and sales of the Products on the Website
2.2. In order to proceed with a purchase, the Customer must follow the following procedures:
I) to select the Product and click the "add to cart" button: at this point a summary of the main features of the selected Product and the total price due will be displayed, including shipping costs (with the exception of any customs duties, if any) and taxes;
II) to click on the "check out" button and fill out the request form ("Order"), indicating the payment method chosen; before proceeding to the next step, the Customer is required to verify the accuracy of the data entered, whose truthfulness is responsible;
III) to read these General Conditions of Sale by clicking on the relevant button and accept them by clicking on the box next to the words "I accept the general conditions of sale";
IV) to click on the "buy" button: the button highlights, as provided by the law, that the order forwarding implies the obligation to pay for the ordered Products.
2.3. As a result, the Customer will receive a confirmation of the order in which will be reported the typology of the ordered Products, the price of each of them, the related taxes, the delivery costs, the payment method chosen and the right of withdrawal according to the following art. 8, exercisable provided that the relevant conditions are met.
2.4. The Contract is concluded and binding upon both Parties when Carmens sends the Order Confirmation to the Customer at the e-mail address indicated on the Website registration.
2.5.The Contract will be archived with the faculty for the Customer to access it.
2.6. In addition to Italian, the contract may be written in one of the following languages: English.

ART. 3 - SHIPMENT AND DELIVERY OF THE PRODUCTS
3.1.The delivery of the Products to the shipping address indicated by the Customer in the Order is made by express courier.
3.2.
Delivery Time of Products: 72 hours for Italy, 4 days for Europe, 3 or more working days for non-European countries after the date of receipt of the Order by Carmens. Times are indicative and not strictly binding for Carmens. In any case, delivery will take place at the latest within thirty days as from the Contract’s conclusion.
3.3. In case of failure to deliver the Products within the agreed deadline or within the term of thirty days, the Customer must exhort Carmens to effect delivery within an additional time appropriate to the circumstances and is entitled to terminate the Contract only if the additional time so granted, expire without the delivery being executed.
3.4. In case of unavailability of one or more Products, occurring after the order confirmation, Carmens will notify the Customer by mail and will carry out the shipment of the remaining Products ordered by the Customer. In such case, the Contract will remain valid only to the Products actually shipped and the Customer cannot refuse the partial delivery or payment of the Products actually delivered nor will it be entitled to compensation but only to receive a refund of the Product Price of unavailable Products, if already paid.

ART. 4 - PRICE, PAYMENT AND INVOICE
4.1. Prices are expressed in Euro (€) and include the value added tax (V.A.T.) in force.
4.2. The total Price resulting at the end of the Order is inclusive of shipping charges, but not of any customs duties and / or additional sales taxes necessary for importing the goods into foreign territory. Any additional charge for customs clearance transactions shall be borne exclusively by the receiving Party.
4.3. The Payment must be done when placing the Order, choosing between credit card or PayPal.
4.4 For credit card payments, Carmens uses the secure SSL system: the order confirmation will transfer credit card data to the cardholder via Secure Socket Layer (SSL) encrypted connection, to authorize and debit . A safe and risk-free procedure that protects Customer from any possible abuse; thanks to this system, Carmens does not display in any way the credit card number of its Customers.
Carmens preserves its right to request additional information to the Customer or to ask copies of documents demonstrating the ownership of the card used. If Customer does not provide such information, Carmens reserves the right not to accept the Order.
4.5 Carmens accepts all major credit cards and prepaid cards registered on the PayPal circuit. Customer financial data will not be shared with Carmens but will be managed directly by PayPal. In case of cancellation of the Order (both by the customer and by Carmens) the amount will be credited to the PayPal account of the Customer. Carmens will not be liable for any delay or damage caused during the reimbursement process.
4.6. Request for invoicing must be done at the same time as the Order. After receiving the confirmation of the purchase, the Customer must send an e-mail to the Customer Service (carmens@carmens.it) indicating:

Business name
Invoicing address
Tax Code and / or VAT Code
The document will be sent to the applicant in digital format by e-mail.
Billing requests will not be accepted in the days following the date of acceptance of the Order.

ART. 5 - RIGHT OF WITHDRAWAL
5.1. According to art. 52 and ss. of the Consumer Code, the Customer, who is acting as a consumer, has the right to withdraw from the Contract without penalty and without specifying its reason within and not later than 14 days after receiving the Products (or, in the case of multiple goods ordered by a single Order and delivered separately, from the day the Customer or a third party designated by him, other than the carrier, acquires the physical possession of the last good). According to the Consumer Code, only natural persons who act for purposes other than business, commercial, craft or professional activities, are consumers. Therefore are excluded from the right of withdrawal, inter alia, legal person and natural person who purchase as a reseller.
5.2. In order to exercise its right of withdrawal, the Client must, prior to the expiry of the deadline referred to in the preceding paragraph, inform Carmens by the on-line return form. The client can find the on-line return form in its private area logging in.
5.3. In order to exercise his right of withdrawal, Customer has to return the Products purchased to Carmens at:

within fourteen days of the date on which he has notified his decision to withdraw from the Contract; the term is considered to be respected if the Customer ships back the Products before the expiration of the 14-day period.
5.4. The return shipping cost is borne by Carmens in Italy, is charged by the customer in all other countries
5.5. The Customer is required to return the Products in a whole state of conservation and with original labels not removed. The packaging must be accurate in order to avoid damages, writing on it or labeling.
The consumer is responsible for the value’s decrease of the Products due to a manipulation of the Products other than the one required to establish the nature, characteristics and operation of the Products.
5.6. If the right of withdrawal has been exercised in accordance with the aforementioned provisions, within 14 days of receipt of the notice of withdrawal, Carmens will return all payments related to the Order to which the withdrawal relates to the Customer, using the same means of payment used by the Customer if this does not involve additional costs to re-credit; however, according to art. 56 of the Consumer Code, Carmens reserves the right to withhold the refund until it has received the Products or until the Customer has proved to have shipped back the Products.
5.7 If the terms and conditions of the right of withdrawal given in this paragraph are not followed, the Consumer will not be entitled to reimbursement of the amounts paid to the Seller; nevertheless, the consumer will have the right to get back, on his/her own expenses, the products he/she had returned to the Seller. Otherwise, the Seller might keep the products as well as the amounts already paid from them.


ART. 6 - CUSTOMER RIGHTS IN CASE OF DIVERSITY OF PRODUCTS.
6.1. If the Customer is a consumer and complains for a defect in a Product, he or she may request repair or replacement without charge, if possible and not excessively costly. If these remedies are not possible or would be excessively costly, they may request a reasonable reduction in the price or termination of the Contract. However, termination of the Contract is excluded in case of minor complaints.
6.2. Following to the complaint Carmens will arrange for the pick-up of the Product and after verifying the existence of the defect, for a replacement of the same or, if the necessary conditions are met , for the partial or full refund of the Price; nevertheless Carmens can propose alternative remedies available, such as for example, the replacement of the Product with a different nature but equivalent value and chosen from those displayed on the Site, namely the issue of a value voucher corresponding to the amount paid, to be used later by contacting Customer Service; in case Customer agrees, Carmens will perform the specifically proposed remedial service.
ART. 7 - PRIVACY
7.1. The data provided by the Customer and necessary for the duly fulfillment of the Contract are processed in accordance with the provisions of Legislative Decree no. 196 on the Protection of Personal Data. For more information, click here http://www.carmens.it/en_gb/help/#privacy

ART. 8 - COMMUNICATIONS
8.1. All communications must be written and sent to the address of the other part and indicated for the Customer, in the Order from the same sender. Carmens’ address for each communication is: carmens@carmens.it
8.2. All communications sent to the e-mail address of the other party, as above mentioned, will be considered effectively sent in writing.

ART. 9 – APPLICABLE LAW AND DISPUTES
9.1. The Parties, by concluding the Contract pursuant to art. 2, agree that the same is governed by Italian law and submitted to the Italian jurisdiction, and that it is expressly excluded from the application of the United Nations Convention on Contracts for the International Sale of Goods.
9.2. Any disputes concerning the validity, performance or interpretation of the Contract and its effects will be competent: a) the forum of the place of residence or domicile of the Customer, if the customer is a consumer and resident or domiciled in Italy; b) exclusively the Court of Padua, in any other case.
9. The consumer resident in the European Union must be aware that the European Commission has established an online platform providing an alternative dispute resolution tool. This tool can be used by the European consumer to resolve any dispute concerning and / or arising out of contracts for the sale of goods and services entered into the network. Consequently and subject to the foregoing of this Article 9, the Customer may use this platform to resolve any disputes arising out of the online contract stipulated with Carmens. How to Order

Ordering in Carmens e-shop is very simple!

Choose from the main menu SHOES | BAGS | the category you were looking for or look at all the products.
Once you find the product page of your interest click on the reference image and you will be brought to the relevant details (model, composition, materials, price etc ...).
Select the size (if you have any doubts, see the 'Size Guide' section) and click 'Add to Cart'. At the right top there's the "Shopping Cart" icon where you can always see a summary of the prices of your selected products and you'll be able to choose whether to continue shopping or check out following the instructions that will be shown to you.
If you want to continue your shopping session, just repeat the same process above; if you want to submit the order you need to click on "Go to check-out" where you can choose the fast purchase or to register your new account. Follow the next steps to finalize the order and, once you have entered all the data, verify that everything is correct and click on confirmation.
Choose a payment method: credit card or paypal, confirm the order and you will receive an e-mail with the summary and confirmation of the order you made.

Then Carmens will contact you later to inform you of all the shipping stages.
If you choosed for the account creation you will be able to consult your orders and your private profile.

Which courier is used for shipment?

Carmens relies on DHL's experience for all shipments.

If I return a product, you'll reimbourse also the return delivery costs?

Delivery costs are free only in Italy. For all the other countries, it's up to the client charge

How can I return one or more item?

Within 14 days from the date of receipt of the order, all you need to do is fill out the return form on the website.
If you completed your order as a registered customer, you can access the return form directly from the orders page in your account.
The products must be returned intact (without damage or wear and tear), in the original packaging, and with the designated return form inserted inside the box.
